1 Acceptance of terms

By creating an account or using TextBack Pro, you agree to these Terms & Conditions, our Privacy Policy, and our Refund Policy. TextBack Pro is intended for business use only — by subscribing, you confirm you are using the service for professional, commercial purposes.

2 Service description

TextBack Pro provides, depending on your plan:

• Automatic SMS reply sent within 5 seconds of a missed call
• Personalised message with your business name and a booking call-to-action
• Instant push notification when a missed call occurs
• Lead tracking dashboard to monitor missed calls and recovery rate
• Smart follow-up SMS sequences — 3h, Day +1, Day +4 (Pro & Scale)
• Booking link embedded in the auto-text (Pro & Scale)
• AI Agent that turns missed calls into booked appointments (Pro & Scale)
• Google Calendar integration to pause auto-replies during appointments (Pro & Scale)
• Up to 5 business numbers with per-location customised messages (Scale)

The service works with your existing UK business phone number via call forwarding — no porting or changes required.

3 Pricing & billing

All prices are in Pounds Sterling (GBP). Prices shown are exclusive of VAT. VAT at the prevailing UK rate (currently 20%) will be added where applicable.

• Billing is monthly or annual, charged on the same date each cycle
• A VAT receipt is emailed to your registered address after each payment
• Payments are processed securely by Stripe — we never store your full card details
• Accepted: Visa, Mastercard, American Express

4 Free trial

TextBack Pro offers a 14-day free trial for new customers. During the trial: a credit or debit card is required to start, you will be notified by email before the trial ends, and no charge is made until the trial period expires. Continued use after the trial requires an active paid plan. You may cancel at any time during the trial with no charge.

5 Cancellation

You may cancel your subscription at any time from your account dashboard or by emailing contact@textback.pro. Cancellation takes effect at the end of the current billing period. Your data is retained for 30 days after cancellation, then permanently deleted. There is no cancellation fee.

6 Acceptable use

By using TextBack Pro, you agree to:

• Use the service only for lawful business purposes
• Comply with the Privacy and Electronic Communications Regulations (PECR), the UK GDPR, and all applicable UK SMS and communications regulations
• Not use the service to send unsolicited bulk messages or spam
• Ensure your business callers are aware they may receive an automated SMS reply
• Keep your login credentials confidential and secure
• Not reverse-engineer, resell, or sublicense the service
• Not use the service to contact individuals who have opted out or requested not to be contacted

Violation of these terms may result in immediate account suspension without refund.

7 Service availability

TextBack Pro targets 99.5% monthly uptime, excluding scheduled maintenance announced at least 24 hours in advance. In the event of unplanned downtime exceeding 4 consecutive hours, affected customers may request a service credit proportional to the outage duration.

8 Limitation of liability

TextBack Pro's liability is limited to the total fees paid by the customer in the 3 months preceding the claim. We are not liable for indirect damages, lost revenue, or lost data. The service is provided "as is" without warranty of fitness for a particular purpose.

9 Promotions & discounts

Promotions apply only for the duration specified. They cannot be combined with other offers unless stated. TextBack Pro reserves the right to modify or discontinue promotions at any time with 30 days' notice to existing subscribers.

10 Governing law & disputes

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms limits any statutory rights you may have under UK consumer protection legislation, including the Consumer Rights Act 2015.

1 30-day money-back guarantee

TextBack Pro offers a full refund within 30 days of your first payment if you are not satisfied.

• No justification required — honored unconditionally
• Refund processed within 5–10 business days to original payment method

2 Additional refund cases

Beyond the 30-day window, refunds may be granted for:

• Service outage: Unavailability exceeding 24 consecutive hours without prior notice
• Duplicate charge: Any billing error refunded in full within 48 hours of confirmation
• Post-cancellation charge: Any charge made after a confirmed cancellation is refunded in full

3 Non-refundable cases

• Requests after the 30-day guarantee period (unless covered above)
• Active use of the service during the period in question beyond the window
• Account suspended due to Terms & Conditions violation
• Free trial period — no payment, no refund applicable

5 Your rights

Under the UK GDPR and Data Protection Act 2018, you have the following rights:

6 Cookies

• Essential cookies: Required for the site to function (auth, security), no consent required
• Analytics cookies: Anonymized usage tracking, require consent
• Marketing cookies: Retargeting and advertising, require consent

7 Payment security

TextBack Pro never stores your full card details. All payments are handled exclusively by Stripe, certified at the highest level of payment security:

8 Policy updates

TextBack Pro reserves the right to update this Privacy Policy at any time. For material changes, users will be notified by email at least 30 days before changes take effect. Continued use of the service constitutes acceptance of the updated policy.

9 Google API Services - Limited Use Disclosure

What we access

• Your Google account email address - to identify the connected account and display it in your dashboard
• Your Google Calendar events (read) - to detect when you are busy and automatically pause SMS auto-replies during appointments
• Your Google Calendar events (write) - to create booking events on your calendar when a customer books through the AI booking agent (Pro & Scale plans only)

How we use it

• Google Calendar data is used solely to provide the calendar integration feature described above
• We do not use Google data for advertising, profiling, or any purpose unrelated to the service
• We do not sell or rent Google user data to any third party
• We do not use Google user data to train AI or machine learning models
• We do not allow humans to read your Google data unless you explicitly request support and grant temporary access

With whom we share or disclose Google user data

Google user data is processed exclusively by the following sub-processors, strictly to deliver the service features described above:

No other third party receives, processes, or has access to Google user data. Google user data is never used for advertising, analytics, or any purpose beyond the immediate service feature.

Token storage & security

• OAuth access and refresh tokens are stored encrypted in our database (Supabase, SOC 2 certified)
• Tokens are used only to make authorised API calls on your behalf
• Access tokens expire after 1 hour; refresh tokens are used automatically to obtain new access tokens

Revoking access

• You can disconnect Google Calendar at any time from your TextBack Pro dashboard (Settings → Integrations → Disconnect)
• You can also revoke access directly from your Google Account permissions page
• Upon disconnection, all stored tokens are permanently deleted within 24 hours

Data retention

• Google OAuth tokens: retained while the integration is active; deleted within 24 hours of disconnection or account deletion
• Calendar event content is never persistently stored, it is read in real time and used only for the immediate purpose (busy check or booking creation)
